These terms apply to every sale by Northeast Metal Supplies, whether you buy at the counter, by phone, through a quote or online. Effective date: to be set at launch.
1. Agreement
When you accept a quote, place an order or pay, you agree to these terms. Terms on your purchase order don’t apply unless we agree to them in writing. If a written quote or account agreement says something different, the quote or agreement wins for that order.
2. Quotes
A quote is valid for the period stated on it. After that, prices and availability must be confirmed again. Quotes are based on the measurements, quantities and specifications you give us. Please check them before you approve the quote.
3. Prices and taxes
Metal prices follow the market. Published prices on our price board and product pages show the date they were set, and they can change without notice. The price on your written quote or order confirmation is the price for that order. We may correct clear clerical errors. New Jersey sales tax is added unless we have a valid exemption or resale certificate on file. Processing and delivery charges are listed separately.
4. Orders
An order is accepted when we confirm it in writing or start processing it. We may ask for a deposit on special orders and processed material, as stated on your quote.
5. Payment
Payment is due as stated on your quote or invoice. Account customers pay on the terms of their approved account. We may hold deliveries on accounts that are past due.
6. Custom, cut and processed material
Material that is cut to length, slit, or ordered to your specifications is made for you. Once processing starts, the order can’t be cancelled, and the material can’t be returned. Check the sizes, colors and quantities on your quote carefully before you approve it.
7. Delivery and pickup
Delivery dates are estimates. We are not responsible for delays caused by weather, suppliers, carriers or other events outside our control. Deliveries are unloaded at ground level with the lift gate. You are responsible for safe access to the site and for someone to receive the order. A second trip may be charged if the truck can’t deliver as planned.
8. Risk of loss and title
Risk of loss passes to you when the material is loaded onto your vehicle at pickup, when it is unloaded at your delivery address, or when it is handed to a freight carrier, whichever applies. Ownership passes to you when we have been paid in full.
9. Inspection and claims
Inspect every order when you receive it, and note visible damage on the delivery receipt. Claims for damaged, incorrect or short material must reach us within 30 days of receipt, with the order number and photos, on our damaged material claim form. Don’t install material you are claiming. If a claim is approved, we repair, replace or credit the material, at our choice.
10. Returns
Returns of unused stock items need our approval first. The rules are on our shipping and returns page.
11. Warranties
Products are covered by their manufacturers’ written warranties, such as the finish and substrate warranties on painted coil. We pass those warranties on to you where we can. Except for those written warranties, and to the extent the law allows, we make no other warranties, including implied warranties of merchantability or fitness for a particular purpose.
12. Advice, estimates and calculators
Our calculators, takeoffs and advice are estimates to help you plan. You and your design professionals are responsible for engineering, code compliance, and installation that follows the manufacturer’s instructions.
13. Limit of liability
To the extent the law allows, our liability for any claim about a product is limited to the price you paid for that product. We are not liable for indirect, incidental or consequential damages, such as lost profits or delay costs.
14. Governing law
These terms are governed by the laws of the State of New Jersey. Any dispute will be heard in the courts of New Jersey.
15. Changes and contact
